"Okami for the Wii" Fan Art contest, co-sponsored by deviantART Inc. and Capcom.
This Capcom's "Okami for the Wii" Fan Art Contest is subject to these complete and Official Rules.
NO PURCHASE IS NECESSARY TO ENTER THIS CONTEST
TERM: The Contest will run April 15, 2008 thru 12 AM Pacific Standard Time, US April 30th, 2008.
THE PRIZES:
Grand Prize Winner shall receive:
- A brand new Nintendo Wii
- A copy of Okami for the Wii
- deviantART prize pack consisting of a 1 year deviantART subscription, deviantWEAR t-shirt of their choice, and a deviantWEAR accessory pack
First runner up shall receive:
- A copy of Okami for the Wii
- deviantART prize pack consisting of a 6 month deviantART subscription, deviantWEAR t-shirt of their choice, and a deviantWEAR accessory pack
Second runner up shall receive:
- deviantART prize pack consisting of a 3 month deviantART subscription, deviantWEAR t-shirt of their choice and a deviantWEAR accessory pack
ODDS OF WINNING:The winner and runner ups are determined on the basis of the merits of the submission as set out in these rules as well as the number of entries.
HOW TO PARTICIPATE IN THIS CONTEST:
This contest is only open to deviantART members who are 13 years or older.
Signing up for the contest: You must be a registered member of www.deviantART.com in order to submit a submission to the contest. No payment or fee is required for registration. You must agree to receive Email/Notes regarding the Capcom's "Okami for the Wii"contest. You must maintain your email address active and current throughout the contest.
If you are already a registered user of www.deviantART.com you are not automatically entered into the Capcom's "Okami for the Wii" Fan Art Contest - you must submit artwork in the fashion required by these rules to enter.
Entries will only be accepted in electronic form by submission through the deviantART submission process. Entries must be submitted during the Term to the Capcom's "Okami for the Wii" Fan Art Contest category or via the following link
Submit! > Community Projects > Contests > 2008 > Okami
The format and style of the submission can range from fully traditional to fully digital or anything in between as long as the content of the submission is consistent with creating artwork based on the Capcom game, "Okami for the Wii". The submission must be in electronic form.
ELIGIBILITY: Anyone who is 13 years or older at the closing date of the Capcom's "Okami for the Wii" Fan Art contest may participate in this Capcom's "Okami for the Wii" Fan Art contest, or if you are under 13 years of age, you must have parental/guardian consent to enter the contest. The parent /guardian may be required to submit identification to deviantART and confirm their consent telephonically. Contact help@deviantART.com for additional information required if you are under 13 years of age. By entering this Capcom's "Okami for the Wii" Fan Art contest you represent to www.deviantART.com that you are either at least 13 years of age or have consent from a parent/guardian. Employees and volunteers of Capcom, Petrol Ad Agency, or www.deviantART.com and the jurors, their immediate families and members of their households are not eligible to participate in this Capcom's "Okami for the Wii" Fan Art contest. By registering to win the prize, the winner grants Capcom and www.deviantART.com permission to use his/her name (including screen name) and likeness for advertising and future promotion purposes without additional compensation (except where prohibited by law).
DISQUALIFICATION: All of your entries in this and all other contests sponsored by www.deviantART.com in the past, present, or future, will be automatically disqualified without notice or recourse if you promote the Contest through unsolicited commercial Email, multiple repetitive postings to UseNet Newsgroups or even one posting to inappropriate UseNet Newsgroups or any other violation of Acceptable Use Policy. Any violation of such Acceptable Use Policy will prevent you from entering any future contest sponsored by www.deviantART.com and we will automatically revoke your membership in the www.deviantART.com web site.
All of your entries will be disqualified, at the sole discretion of www.deviantART.com, if you attempt (i) to enter the Capcom's "Okami for the Wii" Fan Art Contest through any means other than as described in these Official Rules; or (ii) to disrupt the Capcom's "Okami for the Wii" Fan Art Contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with the Capcom's "Okami for the Wii" Fan Art Contest. If either of the above occurs, www.deviantART.com has the right to remedy any such action, disruption, or circumvention, and to seek damages from you to the fullest extent permitted by law.
SELECTION OF WINNER: Winner and Runners up will be selected by a panel of jurors from deviantART. The Winner and Runners up will be notified at the time of selection by a member of the deviantART staff, and have 4 days to contact www.deviantART.com at the email address shown on the notification regarding acceptance of their prize all subject to satisfaction of eligibility requirements. www.deviantART.com reserves the right to modify scheduling of the Capcom's "Okami for the Wii" Fan Art Contest without prior notice. If the deviantART staff or the judges determine in their sole discretion that there is any suspected or actual electronic tampering with the giveaway or if technical difficulties compromise the integrity of the giveaway, the judges reserve the right to void the entries at issue. The Winners and Runners up may be required to sign and return an affidavit of eligibility within 3 days of notification. Failure to return the affidavit in the time noted will result in disqualification and the prize will be awarded to the next selected finalist in sequence. www.deviantART.com may require the finalists to provide proof that he/she is the authorized account holders of the deviantART account used to enter the Capcom's "Okami for the Wii"contest. "Authorized account holder" is defined as the natural person who is registered with www.deviantART.com. Any finalist who does not comply with the Official Rules will be disqualified and the prize will be awarded to the next selected finalist in sequence... Return of any prize or prize notification as "undeliverable" will result in disqualification.
NOTIFICATION: The prize finalists will be notified by e-mail sent to the e-mail address on the www.deviantART.com account and a duplicate notification will be sent via the www.deviantART.com notes system. www.deviantART.com is under no obligation to notify finalists by any means other than e-mail. You must be a registered member of www.deviantART.com at the time that the prize is awarded. www.deviantART.com is not responsible for notifications that are misdirected or not received because of e-mail addresses that are no longer correct. If a potential winner cannot be reached after a reasonable effort has been made during 4 business days from the first notification attempt, such person may be disqualified, and the prize will be awarded to the next selected finalist in sequence. Any prize notification or prize returned as undeliverable will result in the prize being awarded to the next selected finalist in sequence.
REDEMPTION: www.deviantART.com WILL DELIVER DETERMINE DELIVERY METHODS WITH THE FINALISTS VIA EMAIL. CONDITIONS: BY PARTICIPATING IN THE CAPCOM'S "OKAMI FOR THE WII" FAN ART CONTEST, YOU AGREE TO RELEASE AND HOLD WWW.DEVIANTART.COM, CAPCOM, THE JURORS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS, AND ALL PRIZE SUPPLIERS HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND IN CONNECTION WITH THE CAPCOM'S "OKAMI FOR THE WII" FAN ART CONTEST OR ANY PRODUCT PURCHASED, OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURIES, DEATH, AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY, WHETHER SUFFERED BY YOU OR A THIRD PARTY. THIS CAPCOM'S "OKAMI FOR THE WII" FAN ART CONTEST IS VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW AND IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. BY PARTICIPATING, ENTRANTS AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF WWW.DEVIANTART.COM AND WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THE CAPCOM'S "OKAMI FOR THE WII" FAN ART CONTEST OR THESE OFFICIAL RULES. All decisions regarding the Capcom's "Okami for the Wii" Fan Art Contest, including, but not limited to, selecting winners, will be made by www.deviantART.com, whose decisions shall be final. Finalists are solely responsible for all applicable federal, state and local taxes.
Except where prohibited by law, participants (and participants parent/legal guardian if participant is a minor) agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Capcom's "Okami for the Wii" Fan Art Contest shall be resolved individually, without resort to any form of class action, and exclusively by an action in state or federal court located in the State of California, County of Los Angeles and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Capcom's "Okami for the Wii" Fan Art Contest but in no event attorneys' fees; and (c) UNDER NO CIRCUMSTANCES WILL CONTESTANTS BE PERMITTED TO OBTAIN AWARDS FOR AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestant and/or www.deviantART.com in connection with this Capcom's "Okami for the Wii" Fan Art Contest, shall be governed by, and construed in accordance with, the laws of the State of California without regard for conflicts of law doctrine of any jurisdiction.
deviantART, Inc. is not responsible for errors, omissions, interruptions, deletions, defects in part or whole, delays in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for any technical or non-technical network, telephonic, electronic, computer, hardware or software malfunctions of any kind, or inaccurate or partial transmission of or failure to receive entry information by www.deviantART.com on account of technical problems or traffic congestion on the Internet, at any web site or any combination thereof. www.deviantART.com is not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing or downloading any materials in the Capcom's "Okami for the Wii" Fan Art Contest, or for mail-in entries that are lost, late, misdirected, damaged, incomplete, altered, illegible or postage-due. www.deviantART.com reserves the right to cancel temporarily or permanently the electronic method of Capcom's "Okami for the Wii" Fan Art Contest entries if it becomes technically corrupted.
